UP consumer court slaps Rs 9 lakh fine on hospital for ‘wrong diagnosis’
 
 

The Rampur Consumer Forum has imposed a fine of Rs 9 lakh on a private hospital for "medical negligence" leading to the death of a woman (28) and her newborn baby in 2022.

The court observed the medical negligence at the treating doctor's end while delivering the verdict on Thursday.

Advocate Ramesh Kumar Lodhi said, "The case dates back to June 2022, when the hospital staff and the doctor had treated the woman's eyes while neglecting her kidney and liver. It was revealed by the family in court that the doctor didn't even diagnose the symptoms and started treating her eyes."

The victim's family said in court that she was admitted to hospital for childbirth. Three days after caesarean delivery, she experienced pain in her stitches. The family took her to the doctor, who furnished some medicines and suggested they consult another doctor if they had any doubts about the treatment. Thereafter, the victim, Shobha Yadav's condition worsened, and she, along with her baby, died in a different hospital.

As soon as the matter went to court, it ordered an investigation by the chief medical officer's panel, which confirmed that the hospital acted negligently.

Initially, the victim's family approached the police but received no response. They then sought legal action, leading to the consumer forum's ruling. The bench, led by president Devi Shankar Prasad Srivastava and member Manoj Devi, held the hospital accountable and imposed the fine.
