No court relief for AIIMS doctor
 
 

28th December, New Delhi: Saying there was no ground for interference, a Delhi court has upheld an order passed by a magistrate court summoning an AIIMS doctor for allegedly refusing to treat a patient and misbehaving with his family.

Challenging the summon, the doctor contended that he was not named in the chargesheet by the police and there was no evidence against him. The special court, however, rejected his claim and said that metropolitan magistrate has the power to summon accused who have not been chargesheeted. “He can rely upon material placed before him with the chargesheet,” it observed.

“The view taken by the metropolitan magistrate in the impugned order is a possible view. The grounds taken by the petitioner in the additional affidavit cannot be considered at this stage as they are arguments, which are still to be submitted before the trial court and it has yet to take a decision on those grounds which may be addressed at the time of arguments on charge,” the court opined.

According to the complaint, on July 13, 2014 at 9am, Satpal Singh, with his two sons, went to AIIMS emergency department for the treatment of his father. He alleged that the duty doctor refused to provide treatment to his father. Singh said that the duty doctor then called two more doctors and security guards and an altercation took place.
